Welcome to our PatientCare System (PCS). By accessing or using this system, you agree to be bound by these Terms and Conditions. Please read them carefully before proceeding. If you do not agree with any part of these terms, you must not use the System.


 

Interpretation & Definitions 

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of these Terms and Conditions:

"System" refers to the Patient Management System which is available on CodeCanyon.

"User" refers to any individual or entity accessing or using the System.

"Provider" refers to the developers and owners of the System.


 

Acknowledgement

These Terms and Conditions govern your access to and use of the System, forming a binding agreement between you and the Provider. By using the System, you agree to comply with these Terms and Conditions.

Your acceptance of these Terms and Conditions is a prerequisite for accessing and utilizing the System. They outline the rights and responsibilities of all parties involved, ensuring a secure and fair use of the System.

If you do not agree to any part of these Terms and Conditions, you must not access or use the System. By continuing to use the System, you confirm that you have read, understood, and agreed to these terms.

You affirm that you are at least 18 years old. The System is not intended for individuals under 18, and they are prohibited from using it.

Furthermore, your access and use of the System are subject to compliance with any applicable Privacy Policy associated with the System. This Privacy Policy explains how your data is collected, stored, and used, and it is essential that you review it before proceeding.

User Responsibilities

You are responsible for maintaining the confidentiality of any credentials required to access the System.

You agree to provide accurate and truthful information while using the System.

Data and Privacy

The Provider does not have access to any patient data stored or processed using the System. 

The Provider is not liable for any breach of patient data caused by improper use of the System.

The System may contain links to third-party websites or services that are not owned or controlled by the Provider.

The Provider has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. By using the System, you acknowledge and agree that the Provider shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services you visit.

Termination

Your license to use the System will terminate automatically if you violate these Terms and Conditions.

Upon termination, you must cease all use of the System and destroy any copies in your possession.


 

Support & Updates

The Provider may offer support and updates as specified in the license agreement.

The Provider reserves the right to modify, suspend, or discontinue support for the System at any time without prior notice.


 

Limitation of Liability

The System is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

The Provider does not guarantee that the System will be error-free, uninterrupted, or free of harmful components.

The Provider is not responsible for any indirect, incidental, or consequential damages arising out of your use of the System.


 

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the country, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts located in the country.

Your use of the System may also be subject to local, state, national, or international laws, depending on your location or the nature of your activities. It is your responsibility to ensure compliance with all applicable legal requirements.

Dispute Resolution

If you have any concerns or disputes related to the System, we encourage you to first reach out to us directly to seek an informal resolution. We will make every effort to address and resolve your concerns promptly and amicably.

Special Provisions for International Users

  • For EU Residents: If you are a consumer residing in the European Union, you may benefit from additional protections and mandatory provisions under the laws of your resident country.
  • For U.S. Legal Compliance: By using this System, you represent and warrant that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist-supporting" country, and you are not listed on any U.S. government prohibited or restricted parties list.


 

Amendments

The Provider retains the right to revise these Terms and Conditions at its sole discretion. In the event of significant changes, reasonable efforts will be made to notify users in advance, typically at least 30 days before the revised terms take effect. Notification may occur through direct communication channels or updates within the System itself.

Continued use of the System after the revised Terms and Conditions are implemented constitutes your acceptance of the changes. If you do not agree with the updated terms, you must discontinue use of the System.

Severability and Waiver

Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court or other competent authority, the remaining provisions will continue to be in full force and effect. The invalid, illegal, or unenforceable provision will be modified to the extent permitted by law to fulfill the intended purpose or replaced with a valid provision that closely approximates the original intent.

Waiver

The failure of the Provider to enforce any right or provision under these Terms and Conditions shall not constitute a waiver of such right or provision. Any waiver of a specific breach or default must be made explicitly in writing and shall not constitute a waiver of any other breach or default, whether past, present, or future.
